Conditions of Sale

Please read the following terms and conditions carefully, as it’s important for to you understand the contractual relationship you’re entering by purchasing a Ticket by telephone, over the counter or via the website.

1. The management reserve the right to:

1.1 Refuse admission to the premises and / or to remove you from the Venue or any performance in the following circumstances: (a) if you or any of your party behave in a way that will or may adversely impact upon the enjoyment of other people at our Venue or any performance; (b) if in our opinion, you are acting unreasonably whether as a result of you being under the influence of alcohol or drugs or otherwise; (c) if you or any of your party is acting in a threatening or aggressive manner and / or using threatening, abusive or insulting language towards either staff or members of the public.

1.2 Request the Ticket holder to leave the premises and to take any appropriate measures to enforce such a request.

1.3 The Venue will endeavour to admit latecomers at the first suitable opportunity, which may be the interval. For some Events late admission cannot be guaranteed.

1.4 Make any change whatsoever in the performance/event/ programme / cast owing to any unforeseen or unavoidable cause.

1.5 Cancel or abandon the performance/event for reasons beyond its control without notice and without being liable to pay any person any compensation or damage whatsoever other than, at the management’s discretion, a possible percentage or maximum refund to the Ticket holder of the value of the Ticket.

1.6. In exceptional circumstances we reserve the right to offer alternative seats to those specified on the Tickets.

1.7. To place restrictions on the number of Tickets ordered.

2. General Conditions of sale

2.1 Lost or forgotten reserved seating Tickets can be reprinted on the day of performance with proof of ID. Tickets for shows with unreserved seating can be reprinted on the day of performance, but you will be admitted into the auditorium once everyone else has been seated.

2.2 Blackwood Miners’ Institute acts as a Ticket agent for external events. These events are not promoted by Blackwood Miners’ Institute and we take no responsibility for any aspect of their programme or operation. Any queries should be directed to the Promoter concerned.

2.3 Blackwood Miners’ Institute can be hired by external Promoters for events. These events are not promoted by the Venue and we take no responsibility for any aspect of their programme or operation. Any queries should be directed to the hiring company concerned.

2.4 Where a concession is claimed, proof of identity and concession entitlement may be required and only one reduction can be applied to each Ticket. Reductions may be limited.

2.5 You must provide us with accurate details about you and your order at the time of your order, whether such order is made online, over the telephone or in person. On receipt of your Tickets, please check that your Tickets are for the correct event, date and time as mistakes cannot necessarily be rectified on the day of the event.

2.6 Events may be age restricted and it is the responsibility of the Ticket holder to check before purchasing.

2.7 Ticket holders must comply with all relevant statutes, safety announcements and Venue regulations whilst attending the event.

2.8 Children under the age of 16 must be accompanied by an adult (18+), parent or guardian and must each have a valid Ticket.

2.9 People aged 18 months – 15 years are eligible for Under 16 Ticket price reductions where available; under 18 months (babes-in-arms) are free of charge unless otherwise stated.

2.10 The Venue must be informed of any access requirements at the time of sale. If the Venue is not informed of access requirements they cannot guarantee accessible seating, equipment and / or wheelchair spaces can be provided.

2.11 Where you have purchased Tickets / Gift Vouchers on behalf of other people, you are responsible for making such people aware of these terms and conditions and ensuring that they comply with the same.

3. Ticket Cancellations, Exchanges & Refunds

3.1 Refunds are only given when an event has been cancelled. If you are unable to make an event then the Tickets may be exchanged up until 48 hours before the event (subject to availability), or at the discretion of the Box Office staff, it may be possible to provide a credit voucher. There is an administration charge of £1 per Ticket to do this.

3.2 When a performance is cancelled, the full amount will then be refunded by cheque or card, depending on the original payment method. Please note that we are unable to offer a cash refund. Cash payments will be refunded by cheque.

3.3 Refunds shall only be made to the person who purchased the Tickets.

3.4 In the case of a postponed/rescheduled Event, Customers will be offered alternative Tickets of the same value for the new date/time, subject to availability. Where it is not possible to offer Tickets of the same value then alternative Tickets may be offered. Should the Customer not wish to accept these Tickets then a refund can be obtained for the face value of the Tickets.

3.5 The Venue reserves the right to cancel Tickets which they reasonably suspect to have been booked fraudulently, which exceed any advertised limits on the quantity that a person/household can buy, or which they suspect to have been resold, or attempted to be resold, for financial gain. Any applicable restrictions on the quantity of Tickets that can be purchased will be made clear at the time of booking.

4. Reservations

Tickets can be reserved (without immediate payment) if booking by telephone or in person at the Venue’s box office. We will hold your tickets for three days before payment is required, unless there are fewer than three days until the event or if the performance is almost sold out.

Tickets purchased online must be paid in full at the time of booking.

If full payment for reservations is not received within the times specified above, then the reservations will be cancelled.

5. Ticket Prices

5.1 Concession/discounted Ticket prices must be applied for at the time of purchase and cannot be applied to Tickets already purchased. Proof of entitlement to a concession/discount/ Hynt companion Ticket may be requested from the Customer at the time of booking and/or when they attend the Event. Failure to produce reasonable proof of entitlement to a concession/discount/ Hynt companion Ticket may invalidate the Ticket and result in refusal of admittance or ejection from the Venue.

5.2 Concessions/discounts are offered individually and cannot be used in conjunction with one another. If a Customer is eligible for multiple concessionary/discounted rates then they will receive the cheapest singularly discounted price, not a cumulatively reduced price.

5.3 The Venue reserves the right to introduce discounts and special offers at any time and these cannot be applied to Tickets already purchased. All Tickets, price types and discounts are subject to availability, can be changed and/or withdrawn without prior notice and do not apply to Tickets already purchased. The Management reserves the right to introduce offers and price changes without prior notice. The price of the Ticket shall be the price set at the time your order is accepted.

5.4 Ticket prices are subject to change. The Venue reserves the right to change the prices of Tickets and/or introduce discounts/special offers which cannot be retrospectively applied to Tickets already purchased.

6. Booking Fees

6.1 In-line with current industry practice for theatres and Venues, all Tickets for performances at Blackwood Miners’ Institute that are bought in person, over the phone or online for a performance a will be subject to a 75p per Ticket booking fee. This fee is inclusive of the prices you see in our brochure and show listings. The fee contributes to producing your Tickets, processing your order, improving our current technology and continuing to provide an exceptional service to our customers.
We aim to provide the highest level of service to customers whether they visit us in person, call on the phone or interact with us online. This small charge will enable us to continue to do this in the face of increasing demands on valuable resources.

6.2 All Tickets that we sell on behalf of a third party will be subject to an increased Ticket levy to cover the Venue’s processing costs.

7. Prohibitions & Audience Consent

7.1 The unauthorised resale, or attempted resale, of a Ticket is prohibited. The Venue reserves the right to cancel Tickets which it reasonably suspects as being offered for unauthorised resale. Customers who are unsure if a seller is an authorised agent should contact the Venue for clarification. The Venue accepts no responsibility for the validity of Tickets purchased from unauthorised agents.

7. 2 Unless prior written consent is obtained from the Venue, Tickets may not be combined with hospitality, travel, accommodation, merchandise and/or any other product or service to create a Ticket package to sell for commercial gain.

7.3 The use of equipment to record or transmit audio and/or visual material inside the Venue is strictly forbidden. Unauthorised recordings, tapes, films or similar items may be confiscated and destroyed. Any recording made in breach of these conditions shall belong to the Venue and/or Promoter of the Event. Neither the Promoter nor the Venue will be liable for the loss, theft or damage to confiscated items.

7.4 By attending the Event, customers give their consent to filming, photography and sound recording of themselves as members of the audience. The Venue and/or Event Promoter will own the copyright of such material and may use such films/photographs/recordings for any purpose, including commercial purposes, without payment or further notification.

7. 5 Mobile telephones, messaging equipment and all similar personal electronic equipment must be switched off during the Event. Customers who do not comply and disrupt the enjoyment of the Event for other Customers may be ejected from the Venue without refund.

8. Gift Vouchers

8.1 Gift vouchers can be redeemed in full or in part to purchase Tickets for participating Events in person or by telephone via the Venue’s box office or on the Venue’s websites.

8.2 Gift vouchers expire at the end of the month one year after the purchase date. Expired vouchers cannot be redeemed or refunded. The expiry date is clearly printed on all vouchers.

8.3 Gift vouchers cannot be exchanged for cash.

9. Delivery

9.1 If Customers have chosen to receive their Tickets by post or by ‘Print-at-Home’ then it is their responsibility to inform the Venue if the Tickets have not been received prior to the advertised start time of the Event. Where the Venue is not notified of non-receipt of Tickets prior to the commencement of the Event neither duplicate Tickets nor a refund will be offered.

9.2 The Venue reserves the right to post Tickets only to the registered billing address of the card used to purchase them.

9.3 The Venue reserves the right to make Tickets available for collection by the Customer at the Box Office. If this becomes necessary the Venue will make all reasonable endeavours to notify the Customer of the change in advance of the Event and any postage fees paid will be refunded.

9.4 When Tickets are being collected at the box office, the Customer may be requested to present the card used to purchase the Tickets as identification. If this is not possible they must contact the box office prior to the day of the Event.

10. Liability

10.1 The Venue will not be responsible for any injury or loss, theft or damage of Customer’s personal belongings, other than that caused as a result of negligence or other breach of statutory duty.

10.2 Personal arrangements, including but not limited to, travel, accommodation and subsistence relating to the Event are made entirely at the Customer’s own risk and the Venue shall not be liable for any losses incurred from these arrangements.

10. 3 Nothing in these terms and conditions seeks to exclude any liability of the Venue for death or personal injury caused by its negligence or any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.

10.4 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

11. Definitions

‘Ticket’ means any item, tangible or intangible, which confers the right to attend an Event.

‘Customer’ includes both the person who purchased, or intends to purchase, Tickets and those within his or her party who are attending the Event, each of whom must possess a valid Ticket.

‘Venue’, ‘we’, ‘us’ and ‘our’ means Blackwood Miners’ Institute, charity number 1000905 whose registered address is Blackwood Miners’ Institute, High Street, Blackwood, Caerphilly, NP12 1BB

‘Promoter’ means the entity which is staging/producing the Event, which may be different to the Venue.

‘Print-at-Home’ means the delivery method by which PDF Tickets are emailed to the Customer.
